1. General Provisions

These Terms of Business set out the operation of the Mimelo online store, the rights and obligations of the provider and of customers, and govern the business relationship between the contracting parties.

By using the online store, the user confirms that they are aware of these Terms of Business and agree to them.

The provider reserves the right to amend the Terms of Business without prior notice. Amended terms take effect upon publication on the website.

A change to the Terms of Business does not affect orders that were placed and confirmed before the change was published – such orders remain governed by the terms in force at the time the order was placed. The new version of the Terms of Business applies to orders placed after its publication.

2. Scope of Application

These Terms of Business apply to all visitors of the website and to all purchases made through the Mimelo online store.

For matters not governed by these terms, the provisions of applicable legislation of the Republic of Slovenia apply, in particular:

  • the Consumer Protection Act (ZVPot-1),
  • the Code of Obligations (OZ),
  • the Electronic Commerce Market Act,
  • the General Data Protection Regulation (GDPR),
  • and other applicable Slovenian and European legislation.

3. Registration and User Account

Purchases in the online store are possible:

  • by registering a user account, or
  • as a guest, without registration.

When registering, the user must enter true, complete and up-to-date information.

The user is responsible for safeguarding their username and password and for all activities carried out through their account.

If a user suspects that their account has been accessed without authorization, they must notify us immediately at info@mimelo.si.

The provider reserves the right to temporarily or permanently disable a user account in the event of misuse or violation of these Terms of Business.

4. Product Offer

The range of products in the online store may change without prior notice.

The provider strives to ensure accurate product descriptions, photographs, technical data and information on product availability.

Product photographs are for informational purposes. Due to differences in screen settings, minor deviations in the display of colors may occur.

Although we strive to keep stock data up to date, in exceptional cases the availability of a product may change between the placing of an order and its processing. In such a case, the customer will be notified and offered:

  • delivery of the product at a later date,
  • replacement with a comparable product,
  • partial delivery of the order,
  • or a refund of the amount already paid.

5. Prices

All prices in the online store are stated in euros (EUR) and include VAT, unless explicitly stated otherwise.

Prices are valid at the time the order is placed.

The provider reserves the right to change prices without prior notice.

Promotional prices, promotions and special offers are valid until revoked or until stock is sold out, unless otherwise specified.

Promotional codes and coupons generally cannot be combined, unless explicitly stated otherwise.

In the event of an obvious pricing error (for example due to a technical or system error), the provider reserves the right to withdraw from the contract or cancel the order. The customer will be notified of this as soon as possible.

6. Purchasing Procedure

Purchasing in the online store follows these steps:

  1. The customer selects the desired products and adds them to the cart.
  2. Reviews the contents of the cart.
  3. Enters delivery information and selects a payment method.
  4. Before placing the order, reviews the entire order, including delivery costs.
  5. By clicking the order submission button, places a binding order.

Before confirming the order, the customer can review all information, correct any errors, or change the contents of the cart.

After successfully placing an order, the customer receives a confirmation e-mail at the e-mail address provided.

7. Conclusion of the Sales Contract

The sales contract between the provider and the customer is concluded at the moment the customer receives electronic confirmation of receipt of the order.

Before confirming or fulfilling the order, the provider may contact the customer to verify information, product availability, or to resolve any irregularities.

The provider may refuse an order in the event of:

  • obvious pricing errors,
  • incorrect or incomplete customer information,
  • suspicion of misuse,
  • technical errors,
  • force majeure or other extraordinary circumstances.

If an order cannot be fulfilled, the provider will notify the customer as soon as possible.

8. Invoice

After completing a purchase, the customer receives an invoice in electronic form at the e-mail address provided when ordering, or together with the shipment, if so specified.

The customer is obliged to check the accuracy of the information on the invoice and to report any irregularities to the provider as soon as possible.

9. Payment Methods

The following payment methods are available in the Mimelo online store:

  • Payment by payment card (via the Stripe system)
  • Payment by pro forma invoice (bank transfer to the transaction account)
  • Cash on delivery

The provider may change or supplement the available payment methods without prior notice.

An additional charge may apply for cash on delivery, which is clearly displayed to the customer before completing the order.

Payment must be made in accordance with the selected payment method. For payment by pro forma invoice, the order processing period begins once payment is received in the provider’s transaction account.

10. Delivery

We deliver orders through contracted delivery services.

Orders are delivered by DPD; however, the provider reserves the right to choose another contracted carrier where necessary for efficient delivery.

We deliver products to areas where an order can be placed through the online store.

Delivery costs depend on:

  • the country of delivery,
  • the size and weight of the shipment,
  • the selected delivery method.

The final delivery cost is always shown to the customer before the order is placed.

For purchases over EUR 80.00, delivery is free, unless stated otherwise for a specific product.

11. Dispatch and Delivery Time

For products in stock, orders are generally dispatched no later than the next business day after the order is confirmed or, in the case of payment by pro forma invoice, after payment is received.

We do not dispatch orders on Saturdays, Sundays or public holidays.

The delivery time depends on the country of delivery, the chosen carrier, and any unforeseen circumstances beyond the provider’s control.

If there is a significant delay in delivery, we will notify the customer in a timely manner.

12. Partial Deliveries

If an order contains products with different delivery times, or if it is temporarily not possible to dispatch all products at once, the provider may:

  • dispatch the order partially, or
  • dispatch it together once all products have been received.

In the event of a significant deviation from the expected delivery time, we will notify the customer in advance and agree together on the most suitable solution.

13. Personal Pick-up

When placing an order, the customer may also choose personal pick-up.

Personal pick-up is free of charge and is possible at the address:

during the company’s working hours: Monday–Friday between 7:00 and 16:00.

Once the order is ready for pick-up, we will notify the customer by e-mail or telephone.

14. Pre-orders

For certain products, the provider may enable pre-ordering.

If a product is available for pre-order, this is clearly indicated on the product page together with the estimated delivery time.

The estimated delivery time is for informational purposes and may change for reasons on the part of the manufacturer or supplier.

In the event of a significant delay, the customer will be notified and will have the option to withdraw from the order or choose another solution.

15. Return of Products (Right of Withdrawal)

In accordance with the provisions of the Consumer Protection Act (ZVPot-1), in the case of distance contracts (such as purchases made in an online store), the consumer has the right to withdraw from the contract within 14 days of receiving the goods, without giving a reason.

This means that within the statutory period, the product can be returned and a refund of the purchase price requested.

Exercising the Right of Withdrawal

If you wish to withdraw from the contract, notify us of your decision no later than 14 days from receipt of the goods:

The deadline is met if the notice is sent before the 14-day period expires.

Returning the Product

After notifying us of withdrawal from the contract, you must return the product, or send it back, no later than within 14 days.

The returned product should be:

  • undamaged,
  • clean,
  • free from signs of use beyond what is necessary to establish the nature, characteristics and functioning of the goods,
  • if possible, in its original packaging.

You may examine the product only to the extent that you could do so in a physical store. If handling of the product resulted in a decrease in its value, you are, in accordance with the provisions of ZVPot-1, liable for that decrease in value.

The direct costs of returning the goods are borne by the customer, unless explicitly stated otherwise.

Refund of the Purchase Price

We will refund the purchase price no later than 14 days from receipt of the notice of withdrawal from the contract, whereby we may withhold the refund until we receive the returned goods, or proof that the goods have been sent back, whichever occurs first.

The purchase price will be refunded using the same payment method used for the purchase, unless otherwise agreed.

Exceptions

The right of withdrawal does not apply in the following cases, as provided by the Consumer Protection Act (ZVPot-1):

  • goods made to the consumer’s specifications or clearly personalized,
  • sealed goods which are not suitable for return due to health or hygiene reasons, if the consumer has unsealed them after delivery (e.g. pacifiers, bottles and feeding accessories, personal care and hygiene products, cosmetics, underwear),
  • other cases provided for by applicable legislation.

16. Complaints and Exercise of Rights under Conformity of Goods

If you believe that a product is not in conformity with the contract or is defective, please notify us as soon as possible at info@mimelo.si.

The provider is liable for any non-conformity of the goods with the contract that becomes apparent within two (2) years of receipt of the goods. If the non-conformity becomes apparent within one (1) year of receipt, it is presumed to have already existed at the time of receipt, unless the provider proves otherwise or unless this is incompatible with the nature of the goods or the non-conformity. The consumer may first request free repair or replacement of the goods; if this is not possible, is not carried out within a reasonable time, or would cause significant inconvenience to the consumer, the consumer may request a proportionate reduction in the purchase price or withdraw from the contract.

For faster processing, we recommend that you include in your message:

  • the order number,
  • first and last name,
  • a description of the defect found,
  • the date the defect was noticed,
  • photographs or a video of the defect, where possible.

Upon receipt of the notice, we will inform you of the further procedure and, if necessary, ask you to send the product for inspection.

For products that come into contact with food, or are used for feeding, care or personal hygiene, the product must be adequately cleaned before being returned. Products that pose a hygiene risk cannot be accepted for processing until they have been appropriately prepared.

Complaints and claims relating to conformity of goods are handled in accordance with the provisions of the Consumer Protection Act (ZVPot-1) and within the statutory deadlines.

17. Warranty

For products for which the manufacturer or provider issues a warranty, the warranty is enclosed with the product or made available in accordance with applicable legislation.

The warranty does not affect the consumer’s rights arising from conformity of the goods.

18. Product Safety

At Mimelo we pay special attention to product safety.

Before including products in our range, we review the available documentation provided by manufacturers or official suppliers.

Depending on the type of product, this may include various certificates, declarations of conformity or test reports, such as:

  • CE marking,
  • EN 71,
  • OEKO-TEX®,
  • GOTS,
  • LFGB,
  • and other standards and certificates applicable to specific types of products.

Since different product categories are subject to different legal requirements, not all products carry the same certificates or markings.

In addition, Mimelo also complies with the requirements of Regulation (EU) 2023/988 on general product safety (GPSR), which has been in force since 13 December 2024. For products for which GPSR requires it, the product page will include information about the manufacturer or – if the manufacturer is based outside the European Union – about the authorized economic operator established in the EU, together with safety warnings and instructions in the Slovenian language. Any safety concerns, defects or incidents relating to products can be reported at any time at info@mimelo.si.

19. Limitation of Liability

The provider strives to ensure the smooth operation of the online store and accurate, up-to-date information, but cannot guarantee that the website will operate entirely without fault.

The provider is not liable for:

  • temporary unavailability of the website due to maintenance or technical issues,
  • delivery delays resulting from actions of the delivery service or other circumstances beyond its control,
  • cases of force majeure.

The provider’s liability is limited to the extent permitted by applicable legislation.

20. Intellectual Property

The entire design of the Mimelo online store, including texts, graphic elements, icons, design, the Mimelo logo and other original content, is protected by copyright and may not be used without the provider’s prior written consent.

Without the provider’s prior written consent, it is not permitted to:

  • copy,
  • reproduce,
  • publish,
  • distribute,
  • modify, or
  • otherwise use the content for commercial purposes.

Product photographs, brand logos and other materials belonging to manufacturers, brands or suppliers remain the intellectual property of their respective owners and are used with their permission or in accordance with applicable licenses or business agreements. Texts prepared specifically for the Mimelo online store are copyrighted works of the provider, unless explicitly stated otherwise.

21. Protection of Personal Data

The provider processes personal data in accordance with applicable personal data protection legislation and the General Data Protection Regulation (GDPR).

22. Cookies

The website uses cookies and similar technologies to ensure the website functions properly, to analyze visits, and to improve the user experience.

23. Out-of-Court Settlement of Consumer Disputes

In accordance with the Out-of-Court Settlement of Consumer Disputes Act (ZIsRPS), the provider does not recognize any provider of out-of-court settlement of consumer disputes as competent to resolve disputes that a consumer could initiate in accordance with applicable legislation.

We will endeavor to resolve any disputes amicably. If an amicable resolution is not possible, the competent court in the Republic of Slovenia shall have jurisdiction to resolve disputes.

24. Final Provisions

These Terms of Business apply from the day of publication on the website. The Terms of Business are published on the provider’s website and are available to the customer before placing an order.

The provider reserves the right to amend the Terms of Business. Amendments take effect on the day of publication on the website.

The law of the Republic of Slovenia shall apply to the interpretation of these terms and to any disputes.

Should any individual provision of these Terms of Business be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
